Early Neutral Evaluation (ENE)

Early Neutral Evaluation (ENE) is a type of dispute resolution in which an independent evaluator gives the parties involved in a dispute an assessment of the merits of their case, with the aim of giving them an objective view of the strengths and weaknesses of their cases and the likely outcome in formal dispute proceedings.

This may then serve as a basis for negotiations between the parties themselves or as part of a subsequent mediation.

ENE is a voluntary process and can occur at any stage of a dispute, without eliminating other options. ENE may be useful in a range of circumstances, and the process is usually non-binding and without prejudice.
