Harnaek is a Junior Associate at Sharpe Pritchard. He handles contentious claims and construction disputes in both the public sector and private sector.

He acts for a range of clients, which include local authorities, universities, property developers, charities, housing associations, building contractors, property management companies and professionals within the construction and property sectors. He has experience advising on a range of contracts, which include JCT, NEC, PFI contracts and bespoke agreements; and has experience instructing and working alongside counsel and independent experts, which include mechanical and electrical experts, quantity surveyors, architects, and statisticians. His experience includes acting in construction disputes and adjudications, PFI disputes, advising on changes in the law, payment and valuation disputes, extension of time disputes, liquidated damages, and disputes regarding contractual obligations, contract interpretation and breaches of contract.

 

Recent work

  • Thurrock Borough Council v Axis Europe PLC (1329/49) – £11M dispute and adjudication regarding obligations and interpretation under a JCT design and build contract relating to design obligations, the allocation of risk between the parties and whether valid changes to the contract were made and how those changes are to be valued.
  • London Borough of Ealing v M.C.P. Property Services Limited (103522/1) – Adjudication and payment dispute for the valuation and payment of maintenance and minor works carried out under a JCT measured term contract. This dispute required the instruction of an expert statistician to properly advise on carrying out a representative sample review using stratified random sampling.
  • ALondon Borough of Southwark v ISG Jackson Limited (103661/112) – Dispute regarding water ingress in a public library and the allocation of liability for the defective work carried out under a General Works contract which contained contractor designed portions.
  • St Albans City and District Council v Ember Electrical Limited (in liquidation) (100713/20) – Successfully defending a claim made by a liquidator and a statutory demand for payment that had been issued.
  • London Borough of Southwark v Veolia ES Southwark Limited (103661.188) – Providing advice on a change in the law regarding tax relief for fuel and its impact under the provisions of a PFI contract.
  • Milton Keynes Council - Agora Project - Building Safety Act Advice (103594/160) - Advising on the new Part 2A Building Regulations which were introduced by the Building Safety Act and how it will impact works being carried out.
