Allan advises on a range of infrastructure and construction matters with a particular focus on projects, procurement and contracts in the rail, transport and water sectors.
Allan is a Partner in the firm’s Infrastructure team working on construction, public procurement, and project finance (including PPP and other RAB based regulatory structures) matters. Allan works with both regulated bodies and public sector authorities assisting them with their projects.
Allan is an NEC specialist with a depth of experience in advising clients in relation to a number of NEC4 and NEC3 forms of contract across various sectors. Clients value his approachability and ability to provide detailed and intelligible practical advice. He is regarded as a diligent practitioner with an eye for detail.
Case highlights
- Portsmouth Water Limited: Advising on the development of a new c.£300m water storage reservoir. Allan provides commercial and procurement advice and has been involved in the drafting and negotiation of contract documents for a principal designer procurement and later main works contract procurements using the UCR 2016 negotiated procedure. Allan also assisted during the negotiation phase of a bulk supply agreement and continues to advise on associated regulatory and commercial issues.
- Rail infrastructure project in the Government’s Major Projects Portfolio : Allan provides construction and procurement advice in respect of a variety of procurement packages across the project, having particular involvement in procuring bespoke framework agreements under the UCR 2016. Given the scale of the project and the number of key stakeholders (including the Department for Transport), Allan has been required to come up with innovative and dynamic solutions to ensure the delivery of the client’s requirements.
- Department for Health and Social Care: Advising the New Hospital Programme on the construction of 48 new hospitals across England by 2030 including in the procurement of the programme’s delivery partner contract. This project involves managing a complex stakeholder environment including a centralised programme team, hospital trusts, Government, and industry. Allan has advised on the delivery of an innovative commercial and contracting model (including reliance on MMC) to facilitate efficiencies, secure market appetite, and provide confidence to drive investment.
- Merseytravel: Advising the passenger transport executive of the Liverpool City Region Combined Authority on their procurement of a fleet of hydrogen fuel cell buses. Allan is engaged to advise on a range of procurement, state aid, commercial, and transport law elements of the project and lead on the negotiation of leases between Merseytravel and two bus operators in the region.
