Danny specialises in all matters relating to housing management including disrepair claims, injunction proceedings, and possession claims (on all grounds).

Having worked on both sides of housing management disputes, serving tenants earlier in his career before specialising to defend landlords, Danny has a unique insight into the sector and a greater understanding of the full scope of housing disputes.

Danny’s role:

Danny primarily works in disrepair litigation, possession proceedings, anti-social behaviour, and claims under the Environmental Protection Act 1990.

Having worked a wide variety of cases, Danny’s work often yields success in court resulting in clients saving money and achieving a desirable outcome to what otherwise may have been lengthy proceedings.

Additionally, Danny also currently acts for the London Boroughs of Newham and Lambeth, and Cornwall Council, in respect of disrepair claims sourced by Claims Management Companies based outside of London.

Skills and strengths:

Danny recognises the raft of legal challenges and constraints that social landlords navigate on a day-to-day basis and adopts a robust approach in response to those challenges, whilst retaining a level of tact in appropriate cases due to the first-hand knowledge that, each tenant’s situation is unique.

As a keen advocate for the efficiency of the legal process, Danny ensures that his clients receive seamless case management, and this results in positive overall client satisfaction.

  • Danny has acted in a number of important legal cases concerning, for example: the scope of a tenancy agreement in prohibiting anti-social behaviour in an entire London borough; the legal definition of ‘vulnerable’ and the extent to which a trial judge can assist an unrepresented party litigant without ‘entering the arena of conflict’.
  • Successfully defended a social landlord at trial where the tenant and their expert surveyor asserted that all the windows in a Victorian terraced house required complete replacement in order for the landlord to comply with their repairing obligations;
  • Resisted an application to set aside a possession order in circumstances where the possession order was made based on sub-letting/non-occupation whilst the tenant was abroad;
  • Achieved a satisfactory settlement for a social landlord in disrepair proceedings where the tenant’s expert admitted that his CV was inaccurate and had been altered by a third party;
  • Applied successfully to strike out part of disrepair proceedings on the basis that repairs were completed before proceedings were issued against the landlord.
