Successful Transport and Works Order application
Sharpe Pritchard acted for Torbay Council in the successful promotion of the Babbacombe Cliff Railway Order 2009, made by the Secretary of State under the Transport and Works Act 1992. The Order will enable the transfer of the cliff railway to a local Community Interest Company and update the existing legislation relating to the railway. Partner and Parliamentary Agent Alastair Lewis acted for the council throughout. A new record was set in that the order was the quickest to be made under the 1992 Act in a case involving objections dealt with by the written representations procedure. Under the Planning Act 2008, the Infrastructure Planning Commission will become responsible for the authorisation of many of the infrastructure projects that are currently dealt with under the Transport and Works Act procedure, but there will still be some projects, such as this one, which will still require a TWA Order.
