Sharpe Pritchard advises Nottinghamshire County Council on ground-breaking waste PFI project

by ben [June 28, 2006]

Sharpe Pritchard has advised Nottinghamshire County Council on its ground breaking waste PFI project.
The project is the first waste PFI project to be closed under HM Treasury's SoPC3 guidance and Defra's new "Standardisation of waste management PFI contracts: guidance on SoPC3 derogations" (May 2006).
The project involves the financing, design and construction of major new infrastructure across the county and the provision of services across a network of sites including 17 Household Waste Recycling Centres, recycling and composting facilities and the management and diversion of residual waste.

The project, won by Veolia Environmental Services, will be delivered through an innovative contract structure. Services will be operational from June 2006 for 26 years.
Sharpe Pritchard's waste and procurement team was led by Nicola Sumner (Partner, Projects and Head of Waste) assisted by Sheila Storey, Gareth Rees, Brian Yates, and Kate Lewis. The property team was led by Jo Pickering (Partner and Head of Commercial Property). John Sharland (Partner) advised on TUPE.

Nicola Sumner said "Sharpe Pritchard are delighted to have advised on this significant waste project. Teams on both sides have worked extremely hard to complete this complex transaction. We have worked closely with Defra, Partnerships UK and 4Ps to structure a deal that will open the door for other local authorities needing to procure long term waste management contracts to achieve their challenging recycling and BMW diversion targets. We have also worked closely throughout the project with Nottinghamshire County Council's in-house Legal Services under a partnering arrangement which has delivered real benefits to the project."

Pinsent Masons acted for Veolia Environmental Services.
